AN ORDINANCE AMENDING SECTION 36-11.5 RELATING TO RESTRICTED RESIDENT DECAL PERMIT PARKING OF ARTICLE II, “PARKING,” DIVISION 1 “GENERALLY,” IN CHAPTER 36 OF THE TOWNSHIP CODE ENTITLED “TRAFFIC" TO ADD THERETO A PORTION OF RENSSELAER ROAD

BE IT RESOLVED by the Township of Teaneck that Ordinance #27-2019 pass upon second and final reading and that the Township Clerk is hereby authorized and directed to advertise the same according to law and to provide the appropriate notices in accordance with law.

WHEREAS, the Township Council has heretofore adopted Ordinances 24-2017 and 30-2017 respecting restricted resident  decal parking; and

              WHEREAS, the Township Council wishes to add a portion of Rensselaer Road for restricted resident decal parking during certain hours and to simplify the format of such ordinance; and

              WHEREAS, N.J.S.A. 39:4-8c has been held to authorize the restriction of parking along designated public streets to residents only;

              NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Teaneck, Bergen County, New Jersey, as follows:

SECTION 1.  Section 36-11.5 entitled “Restricted Resident Decal Parking” of Article II, “Parking,” Division 1, “Generally,” in Chapter 36 “Traffic” of the Teaneck Township Code is hereby amended to read in full as follows:

Except for delivery vehicles, moving vans or service vehicles (e.g., plumbing, electrical, landscaping) while actually making deliveries to or pick-ups from or while performing services at premises located along or adjacent to the following portions of streets or except where the stopping, standing or parking of any vehicle is otherwise prohibited by statute, no person shall park a vehicle on the following streets or portions thereof, without first obtaining and displaying a resident decal therefor pursuant to Section 36-11.3 hereof, during the hours and days indicated:

 

 

Amsterdam Avenue. Both sides. Entire length. Except between the hours of 3:00 p.m. Fridays through 7:00 a.m. Mondays, and holidays.

 

Maple Avenue. North side, from River Road to Catalpa Avenue.  Except between the hours of 3:00 p.m. Fridays through 7:00 a.m. Mondays, and holidays. 

 

Maple Avenue. South side, from River Road to Catalpa Avenue.  Except between the hours of 3:00 p.m. Fridays through 7:00 a.m. Mondays, and holidays.

 

Martense Avenue. North side, from River Road to Catalpa Avenue.  Except between the hours of 3:00 p.m. Fridays through 7:00 a.m. Mondays, and holidays.

 

Martense Avenue. South side, from River Road to Catalpa Avenue.  Except between the hours of 3:00 p.m. Fridays through 7:00 a.m. Mondays, and holidays.  Rensselaer Road. Both Sides, from Ward Plaza to Stuyvesant Road.  Between the hours of 10:00 p.m. and 6:00 a.m.  All days.   Sherman Avenue. Both sides, between Albin Street and Mildred Street.  Between the hours of 10:00 a.m. and 12:00 noon, except Saturdays, Sundays and holidays.

 

Tilden Avenue. North side, from River Road to Catalpa Avenue.  Except between the hours of 3:00 p.m. Fridays through 7:00 a.m. Mondays, and holidays. 

 

Tilden Avenue. South side, from River Road to Catalpa Avenue.  Except between the hours of 3:00 p.m. Fridays through 7:00 a.m. Mondays, and holidays.

 

Ward Plaza. South side.  Except between the hours of 3:00 p.m. Fridays through 7:00 a.m. Mondays, and holidays.

 

 

Section 2.  Inconsistency.  All ordinances or parts thereof inconsistent with the provisions hereof, are hereby repealed to the extent of such inconsistency.

Section 3.  Severability.  If any section, sentence, clause, or other portion of this ordinance, or the application thereof to any person or circumstance, is adjudged to be invalid by a court of competent jurisdiction, such judgment shall not affect, impair or repeal the remainder of this ordinance.

Section 4.  Effective date.  This ordinance shall take effect upon the expiration of twenty days following passage and publication as required by law.
